Please read these Terms of Use carefully before accessing or using the AVIE web application (the 'Service'). By accessing or using the Service, you agree to be bound by these Terms of Use. If you do not agree to all of these terms, then you may not access or use the Service.

1. Introduction

AVIE is an AI-powered assistance web application operated by Volunteer Edinburgh, located at 222 Leith Walk EH6 5EQ, Edinburgh, designed to support volunteer managers in their tasks. These Terms of Use govern your access to and use of the AVIE website and application.

2. Acceptance of Terms

By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use. These Terms constitute a legally binding agreement between you and the provider of AVIE.

3. Description of Service

AVIE provides AI-powered tools and features to assist volunteer managers with various tasks, such as volunteer recruitment, communication, scheduling, and reporting. The specific features available to you will depend on your access level (Free or Member).

4. User Accounts

To access certain features of the Service, you may be required to create a user account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

5. Access Levels

AVIE offers two access levels:

Free

Access: This level allows access to a limited set of features of the Service, as determined by the provider.

Member

Access: This level provides access to a wider range of features and functionalities of the Service. Member Access is exclusively available to member organisations of Volunteer Edinburgh.

6. Membership Terms (for Member Access)

Eligibility:

To be eligible for Member Access, your organisation must be a current member organisation of Volunteer Edinburgh.

Fees and Payment:

  • The annual Volunteer Edinburgh membership fee is £45 (organisations with an annual income of less than £100,000) or £60 (annual income in excess of £100,000). This fee grants access to the Service for 1 user from your organisation.
  • For each additional user member beyond this user, your organisation will be required to pay an additional fee of £10 per user member.

Duration and Renewal:

Your Member Access will be coinciding with your organisation's membership with Volunteer Edinburgh. Renewal of your AVIE Member Access is contingent upon continued membership with Volunteer Edinburgh and payment of the applicable annual fees.

Cancellation:

If your organisation's membership with Volunteer Edinburgh lapses or if the annual AVIE membership fee is not paid, your Member Access to AVIE will be suspended.

You agree to use the Service in a responsible and lawful manner. You shall not:

AVIE uses artificial intelligence to provide the results. While there are currently no explicit limits on the usage of the AI features, we reserve the right to monitor usage patterns. If we detect any activity that we deem to be unusual, excessive, or potentially harmful (e.g., automated or bot-like behaviour, attempts to overload the system, or any usage that negatively impacts the performance or availability of the Service for other users), we may, at our sole discretion, temporarily or permanently block access to your account without prior notice.

9. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Volunteer Edinburgh and its licensors. The Service is protected by copyright, trademark, and other laws. You may not modify, reproduce, distribute, create derivative works of, publicly display, or in any way exploit any of the content or software of the Service without the prior written consent of the provider.

AI-generated content: Any AI-generated content provided to you through this web application is for your use and benefit under these Terms. While Volunteer Edinburgh owns web application that produces the AI-generated content, you are granted a non-exclusive, worldwide license to use, reproduce, and modify the output for lawful purposes, subject to any license restrictions on the input data or other specified terms. You remain responsible for ensuring that your use of the AI-generated content complies with all applicable laws and does not infringe upon any third-party rights.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. THE PROVIDER OF AVIE MAKES NO WARRANTIES, EXPRESSED OR IMPLIED, REGARDING THE SERVICE, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE. YOU ACKNOWLEDGE THAT YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE PROVIDER OF AVIE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES) ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF THE PROVIDER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE PROVIDER'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT OF FEES PAID BY YOU (IF ANY) IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless the provider of AVIE, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your breach of these Terms of Use or your use of the Service.

13. Termination

The provider of AVIE may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms of Use. Upon termination, your right to use the Service will immediately cease.

14. Data Removal

Should you wish to have your organisation's or your user account's data removed from AVIE, please contact us using the contact information provided below. We will process your request and remove your data as soon as practically possible. Please note that some data may be retained for a certain period as required by law or for legitimate business purposes.

15. Governing Law

These Terms of Use shall be governed by and construed in accordance with the law of Scotland, without regard to its conflict of law provisions.

16. Changes to Terms

The provider of AVIE reserves the right to modify or revise these Terms of Use at any time, without prior notice. By continuing to access or use the Service after any such changes become effective, you agree to be bound by the revised Terms of Use. It is your responsibility to review these Terms of Use periodically for updates.
